This Legal Notice governs access to and use of the Abadía da Cova Wine Club website (hereinafter, “the Club” or “the Site”), available at club.abadiadacova.com. The Club is a wine subscription service and an independent project from the corporate website adegasmoure.com.

2. Purpose

In compliance with Spanish Law 34/2002 of 11 July on Information Society Services and Electronic Commerce (LSSI-CE), users are hereby informed of the conditions of use of the Site.

The purpose of the Site is the promotion and contracting of the Abadía da Cova Wine Club subscription, through which the subscriber periodically receives a selection of Adegas Moure wines (Summer Pack, Complete Pack and Christmas Pack). The financial and contractual terms of the subscription are set out in the Terms of Sale.

3. Conditions of access and use

Access to the Site is free of charge, except for the cost of the telecommunications connection. The user undertakes to make appropriate use of the content and services in accordance with the law, this Legal Notice, morality and public order.

The following is prohibited: (i) carrying out unlawful, illegal activities or activities contrary to public order; (ii) disseminating racist, xenophobic, pornographic content or content that infringes human rights; (iii) causing damage to the physical and logical systems of the owner or third parties, or introducing or spreading viruses; (iv) attempting to access or use the email accounts of other users or restricted administration areas.

4. Contracting and legal age

Subscription contracting is restricted to persons over 18 years of age, as the Club markets alcoholic beverages. By subscribing, the user declares that they are of legal age.

Alcohol consumption may be harmful to health; the Club promotes moderate and responsible consumption. The contracting process, prices, shipping, billing, cancellation and withdrawal are governed by the Terms of Sale.

The age confirmation made on this website is an initial access control and does not replace any verification required at the time of sale or delivery. Adegas Moure may request an official identity document and refuse the sale or delivery if legal age is not proven.

5. Payments

Payments are processed securely through the Stripe platform. Card or bank account (IBAN) details are never stored on the Club’s servers: Stripe acts as the payment service provider and is responsible for processing such data. For more information, please see the Privacy Policy.

6. Intellectual and industrial property

All elements of the Site (text, images, photographs, trademarks, logos, trade names, designs, audio and video files, software and source code) are owned by Adegas Moure, S.A. or by third parties who have authorised their use, and are protected by intellectual and industrial property law.

The reproduction, distribution, public communication, transformation or any other form of exploitation, in whole or in part, of such content without the express authorisation of the owner is expressly prohibited, except for personal and private use.

7. Links

The Site may contain links to third-party sites, including the corporate website adegasmoure.com and service providers such as Stripe. The owner is not responsible for the content or operation of such sites, which are managed by their respective operators.

8. Disclaimer

The owner is not liable for: (i) damage arising from failures or disconnections in networks or servers; (ii) the presence of viruses or other harmful elements introduced by third parties that may alter computer systems; (iii) the fraudulent or improper use that third parties may make of the Site’s content.

The owner will endeavour to keep the Site available and operational but does not guarantee the absence of interruptions due to maintenance or causes beyond its control.

9. Data protection

The processing of users’ personal data is governed by the Privacy Policy, in accordance with Regulation (EU) 2016/679 (GDPR) and Spanish Organic Law 3/2018 (LOPDGDD). Users may exercise their rights of access, rectification, erasure, objection, restriction and portability by contacting abadiadacova@adegasmoure.com.

10. Applicable law and jurisdiction

This Legal Notice is governed by Spanish law. For the resolution of any dispute, the parties submit to the Courts and Tribunals of Lugo, unless consumer protection regulations establish a different jurisdiction (generally, that of the consumer’s domicile).

11. Amendments

The owner reserves the right to amend this Legal Notice to adapt it to legislative developments or changes in the service. Periodic review is recommended.
